The government of India initiated the Startups Intellectual Property Protection Scheme (SIPP) to address several key objectives and promote innovation and entrepreneurship among startups. Initially launched as a pilot initiative in January 2016, this scheme was set to conclude in March. The successful implementation of the SIPP Scheme (SIPP) necessitates the periodic selection of facilitators by the Controller General of Patent, Design, and Trademark (CGPDTM). It is also the responsibility of the CGPDTM to monitor and ensure that these facilitators adhere to their prescribed duties. Moreover, the CGPDTM possesses the power to replace or remove facilitators if specific conditions are met, such as the submission of a complaint against a facilitator by a startup, the facilitator’s refusal to assist a startup or reports of professional misconduct from any source.
Eligibility Criteria for SIPP Scheme (SIPP)
- Startups having an annual turnover of up to Rs. 25 are eligible to apply.
- A DIPP-issued Certificate of recognition is required for startups.
- Entities created through business reconstruction or splitting are not eligible.
- To meet the criteria, an entity should be registered or incorporated in India, with a maximum age of seven years (ten years for biotechnology startups).
- To quality, startups should be dedicated to advancing, deploying, innovating, or commercializing processes, products, or services driven by IP technology.
Eligible Facilitator Under SIPP Scheme 2024
- Government bodies such as TIFAC, BIRAC, NRDC, DEITY, etc.
- Individuals who are registered as trademark agents with the CGPDTM.
- To meet the criteria, the patent agent should hold registration with the CGPDTM.
- Any lawyer, as defined by The Advocates Act, 1961, who is authorized to practice law in accordance with the rules established by the Bar Council of India at any given time. This lawyer should also have a thorough understanding of the relevant Acts and Rules and actively engage in the submission and processing of patent, trademark, and design applications.
